    1.2. The Site offers its visitors an overview of the activities and services provided by the Cercle de Wallonie (hereinafter referred to as the "Activities").

    1.3. Any questions or complaints regarding the Site, these terms and conditions of use (hereinafter, the "Terms of Use"), the Privacy Policy (hereinafter, the "Privacy Policy"), and the cookie policy (hereinafter, the "Cookie Policy") may be addressed to the Circle at the address mentioned above or to the following email address: [email protected]

     
    2. ACCEPTANCE

    2.1. Access to the Site is subject to these Terms of Use, the Privacy Policy, the Cookie Policy, as well as applicable laws and regulations. Consequently, access to the Site implies the full and unconditional acceptance by the user (hereinafter referred to as "the User") of these Terms of Use, the Privacy Policy, and the Cookie Policy. 

    2.2. These Terms of Use, the Privacy Policy, and the Cookie Policy exclusively govern the relationship between the User and the Circle regarding the use of the Site and Activities. They are available for consultation at any time on the Site.

    3. SITE ACCESSIBILITY AND FUNCTIONING

    3.1. The Circle will ensure, as far as possible, that the Site is up to date and remains accessible to a normal number of Users. However, the Circle does not guarantee that the various functions of the Site will be available without interruption or error, that defects will be corrected immediately, or that the server providing it is free of viruses or other harmful components.

    3.2. The Circle cannot be held responsible for any loss and/or damage, of any kind, arising from the suspension, interruption, disruption (technical), slowdown, difficult accessibility and/or cessation of access to all or part of the Site, or from viruses or other harmful elements present on the Site.

    3.3. If the User notices the presence of an error, a virus, or other harmful elements on the Site, they are invited to report it to the Circle at the following address:[email protected]so that necessary measures can be taken. The Circle advises the User, in any case, to install firewalls, anti-virus software, and other necessary protection software on their computer to prevent any potential damage to it.

    3.4. the Circle reserves the right to suspend or stop all or part of the Site, at any time, without justification and without prior notice.            

    4. USE OF THE SITE

    4.1. The User agrees to use the Site solely for its intended purpose, excluding any other use. The User is required to ensure that all information communicated is accurate and up to date. The User agrees to use the Site in good faith and to comply with applicable laws, and in particular to refrain from:

    - envoyer au Cercle du contenu ou des communications fausses ou trompeuses, (et de mettre à jour ce contenu, le cas échéant, afin de garantir qu'il ne devienne pas faux ou trompeur), obscène, raciste ou xénophobe, abusif, illégal, mensonger, attentatoire à la vie privée d'autrui, offensif, dommageable, violent, menaçant ou harcelant, diffamatoire, constitutif d'une infraction à un droit de propriété intellectuelle ou à tout autre droit, ou qui encourage ou participe à l'une de ces choses ;

    fournir des adresses emails ou d’autres types de contenu au Cercle sans avoir obtenu le consentement préalable des personnes concernées ;

    envoyer au Cercle du contenu violant les droits d'un tiers ou leur portant préjudice d'une quelconque manière que ce soit (droits de propriété intellectuelle, vie privée, secrets d’affaires etc.) ;

    envoyer au Cercle du contenu qui dirige vers des sites web illégaux ou qui contiennent du contenu inapproprié ;

    utiliser le Site pour l'envoi de courrier indésirable, non sollicité, pyramidal ou pour un procédé similaire ou frauduleux ;
    contourner les dispositifs techniques de protection des documents et éléments multimédias ;

    toute action qui puisse avoir pour effet de perturber le bon fonctionnement du Site, du Service, y compris l'utilisation de vers informatiques, de virus ou l'envoi massif de courriers ;

    tenter de violer l'accès non autorisé à une partie quelconque du Site ou à des équipements utilisés pour l'exploitation du Site ;

    utiliser un faux nom, un pseudonyme, ou se prévaloir de l'identité d'une autre personne ou entité ;

    utiliser le Site à des fins autres que celles prévues par les CGU.

    4.2. The Circle shall not be held responsible in any way for the User's failure to comply with the Terms of Use, the Cookie Policy, the Privacy Policy, and/or applicable laws or regulations.

    4.3. The User guarantees the Circle against any action, claim, or complaint from third parties (including public authorities) related to their use of the Site.

    4.4. The User uses the Circle at their own risk. The Site, its components, and all information, software, installations, and related services are provided as is, subject to availability, without any warranty of any kind (either express or implied) and within the limits of applicable law.

    4.5. The Circle disclaims any responsibility for loss or damage (direct, indirect, material, or immaterial) resulting from the use of the Site and its components, or from the inability to use the Site.

    4.6. The User is also required to inform the Circle immediately in writing if they become aware of any inappropriate behavior or use related to the Site by sending an email to the following address:[email protected]  

     

    5. LINKS TO AND FROM OTHER SITES

    Hyperlinks to other websites may appear on the Site. Furthermore, some websites may include a link to the Site. These third-party sites are not controlled by the Circle, which therefore assumes no responsibility for their operation, content, and use. Unless expressly stated otherwise by the Circle on the Site, the existence of such links does not imply any endorsement by the Circle of these third-party sites or of any use that may be made of them, nor any association or partnership with the operators of these sites.



    6.INTELLECTUAL PROPERTY RIGHTS

    6.1. The Site and its components (trademarks, logos, graphics, photographs, animations, videos, texts, etc.) are the property of the Circle. They are protected by intellectual property rights (notably copyright, design rights, trademark rights, etc.) and may not be reproduced, used, or distributed without prior written permission from the Circle or, where applicable, from the rights holder concerned, under penalty of constituting an offense of copyright infringement and/or design and model infringement and/or trademark infringement, punishable by three months to three years of imprisonment and a fine of 100 to 100,000 euros or one of these penalties only.

    6.2. The Circle grants, through these Terms of Use, the User a non-exclusive, non-transferable license for an indefinite period, which can be revoked at any time without notice, to access the content of the Site, display it, and download it solely for the purpose of display. The User may also print a copy of the content displayed on the Site for personal use, provided that they do not alter the content of the Site in any way and that they retain all acknowledgments of authorship and origin of the Site. Reproduction is therefore only permitted for strictly private purposes as defined in Article XI.190 5° of the Economic Law Code.

    6.3. Any use of the Site and its components not covered by this article is strictly prohibited.



    7. CLAIM

    To be valid, any potential claim by the User related to the Site must be communicated in writing within five (5) calendar days from the date of becoming aware of the fact that gives rise to the claim. The absence of any contestation following the aforementioned rules results in the User's unconditional and unreserved acceptance of the fact that gives rise to the claim and, de facto, the definitive waiver of any claim in this regard.

     

    8. MODIFICATIONS AND LANGUAGE VERSIONS

    The Circle reserves the right to modify and update, at any time, by notifying Users through the Site, these Terms of Use, the Privacy Policy, and the Cookie Policy, access to the Site and its content. All of these modifications are binding on Users upon each access to the Site.

    In the event of discrepancies between the language versions of these Terms of Use, the Privacy Policy, or the Cookie Policy, the French version shall prevail.

     

    9. VALIDITY OF CONTRACTUAL CLAUSES

    9.1. The Circle's abstention from invoking, at a specific moment, a provision of these Terms of Use shall not be interpreted as a waiver of its rights to assert them later under this provision.

    9.2. The nullity, expiration, or unenforceability of all or part of any of the provisions that precede or follow shall not result in the nullity of the entirety of these Terms of Use. The provision that is wholly or partially null, expired, or unenforceable shall be deemed unwritten. The Circle agrees to substitute this provision with another that will pursue, to the extent possible, the same objective.

    10. APPLICABLE LAW AND COMPETENT JURISDICTION

    10.1. The validity, interpretation, and/or enforcement of the Terms of Use are governed by Belgian law, to the extent permitted by the applicable rules of private international law.

    10.2. In the event of a dispute regarding the validity, interpretation, or execution of the Terms of Use, the Courts and Tribunals of the judicial district of Brussels shall have exclusive jurisdiction, to the fullest extent permitted by applicable private international law.

    10.3. Before undertaking any steps aimed at the judicial resolution of a dispute, the User and the Circle agree to attempt to resolve it amicably. To this end, they first contact each other before resorting, if necessary, to mediation, arbitration, or any other alternative dispute resolution method.
